1. Purpose of This Disclaimer

This disclaimer sets out important limitations and clarifications regarding the use of the MyProtektor platform, including the website at www.myprotektor.co.za and the MyProtektor mobile application (collectively, the "Platform"). By accessing or using the Platform, you acknowledge that you have read and understood this disclaimer and agree to its terms.

2. Informational and Operational Use Only

The Platform is provided for informational and operational purposes only. MyProtektor enables security companies, their personnel, and their clients to manage incidents, track guard locations, coordinate patrol activities, and communicate through digital tools. While we strive to provide accurate and timely functionality, the information displayed on the Platform (including incident reports, location data, and status updates) may be subject to delay, inaccuracy, or incompleteness.

Users should not rely solely on data presented through the Platform when making safety-critical decisions. Independent verification of important information is always recommended.

3. MyProtektor Is Not an Emergency Service

MyProtektor is not an emergency service and does not replace the South African Police Service (SAPS), emergency medical services (EMS), fire services, or any government emergency authority.

The Platform facilitates communication between users and their chosen private security providers. MyProtektor does not itself dispatch response personnel, provide armed response, or guarantee any specific response time. In any situation involving immediate danger to life or property, you must contact the relevant emergency services directly by dialling the appropriate emergency number for your area.

The panic alert feature is designed to notify designated personnel within your organisation. It does not connect to SAPS, 10111, or any public emergency dispatch centre.

Service Classification: MyProtektor is designed and intended to operate as a software tool that facilitates communication and operational coordination. It is not intended to provide security services as defined in the Private Security Industry Regulation Act 56 of 2001. All security services, armed response, guard deployment, and incident intervention are provided exclusively by independently licensed security companies using this software.

Alert Delivery Limitations: MyProtektor does not control and cannot guarantee whether or how organisations respond to alerts sent through the Platform. The delivery, receipt, and actioning of alerts depends on network availability, device status, third-party push notification services (Google FCM, Apple APNs), and the availability and decisions of the receiving organisation's personnel. For any situation involving immediate danger, you must contact local emergency services directly.

Offline Queuing: When a device is offline, the Platform may store alert data locally for later transmission. Such locally queued alerts are transmitted on a best-effort basis once connectivity is restored. MyProtektor does not guarantee the delivery, timeliness, or completeness of any alert queued while offline. Users must not rely on offline queuing as a substitute for directly contacting emergency services.

4. User-Generated Content and Incident Data

Much of the content visible on the Platform originates from end users, including security guards, administrators, and LiteClient subscribers. This user-generated content includes incident reports, panic alerts, photographic evidence, and location check-ins. Such content:

• Is submitted by individual users and is not independently verified by MyProtektor in real time.
• May be inaccurate, incomplete, outdated, or presented without full context.
• Should not be treated as the sole basis for making safety or security decisions.
• Remains the responsibility of the user who submitted it.

MyProtektor does not endorse, guarantee, or assume liability for the accuracy or reliability of any user-generated content.

5. Third-Party Services and Integrations

The Platform relies on a number of third-party technologies and service providers to deliver its functionality. These include, but are not limited to:

• Cloud and authentication providers: Backend infrastructure, authentication, and data storage.
• Mapping providers: Mapping, geolocation services, and route visualisation.
• Payment providers: Payment processing and subscription billing.
• Independent security companies: Private security firms that use MyProtektor to manage their operations and respond to incidents.

MyProtektor has no control over the availability, reliability, or performance of these third-party services. Interruptions, errors, or outages affecting any third-party service may impact the functionality of the Platform. MyProtektor is not liable for any loss, damage, or inconvenience arising from the failure or unavailability of any third-party service.

The security companies that use MyProtektor operate independently under their own licences, terms of service, and regulatory obligations. MyProtektor does not employ, control, or supervise the staff of any security company and accepts no responsibility for their actions, omissions, or service quality.

6. GPS and Location Accuracy Limitations

The Platform uses GPS and network-based location services to track guard positions, record incident locations, and facilitate emergency communication and alert delivery during emergencies. Location accuracy depends on a number of factors outside MyProtektor's control, including:

• The quality and capabilities of the user's device and its GPS hardware.
• Environmental conditions such as tall buildings, dense vegetation, underground areas, and adverse weather.
• Availability and strength of cellular network and Wi-Fi signals.
• Device battery level and power-saving settings that may throttle location services.
• Operating system restrictions on background location access (particularly on Android and iOS).

GPS coordinates displayed on the Platform should be treated as approximate. MyProtektor does not guarantee the accuracy, timeliness, or continuity of location data and accepts no liability for decisions made based on location information that proves to be inaccurate.

7. Platform Availability

MyProtektor endeavours to maintain continuous availability of the Platform but does not guarantee uninterrupted access. The Platform may be temporarily unavailable due to:

• Scheduled maintenance and software updates.
• Unplanned outages affecting our infrastructure or third-party service providers.
• Network connectivity issues on the user's end.
• Force majeure events including natural disasters, power failures, or civil unrest.

MyProtektor is not liable for any loss, damage, or missed alerts resulting from Platform downtime or degraded performance, regardless of the cause.

8. Limitation of Liability

To the fullest extent permitted by the laws of South Africa, MyProtektor's total aggregate liability to any user for all claims arising out of or in connection with the use of the Platform shall be limited to the lesser of (a) the total fees paid by that user to MyProtektor in the twelve (12) months immediately preceding the event giving rise to the claim, or (b) fifty thousand South African Rand (R50,000).

In no event shall MyProtektor be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to loss of profits, loss of data, loss of business opportunity, personal injury, or property damage, whether arising from contract, delict, negligence, or any other legal theory, even if MyProtektor has been advised of the possibility of such damages.

Nothing in this disclaimer limits or excludes liability that cannot lawfully be limited or excluded under applicable South African law.

9. No Professional Advice

Nothing on the Platform constitutes professional security advice, legal advice, insurance advice, or any other form of professional counsel. The Platform is a software tool designed to assist with operational management. Users should seek independent professional advice from appropriately qualified practitioners before making decisions relating to physical security arrangements, legal compliance, insurance coverage, or risk management.

10. Governing Law and Dispute Resolution

This disclaimer is governed by and construed in accordance with the laws of the Republic of South Africa.

Before initiating formal legal proceedings, you agree to first attempt to resolve any dispute informally by contacting us in writing. We will endeavour to reach a mutually satisfactory resolution within thirty (30) days. If informal resolution is unsuccessful, either party may refer the dispute to mediation administered by a mutually agreed mediator in South Africa, with costs shared equally. If mediation does not resolve the dispute within sixty (60) days, either party may pursue the matter through the courts of the Republic of South Africa.
