The Website is owned and operated by Mike Roth, Founder, Michael-Gaismayr-Strasse 52b, 6900 Bregenz, Austria, European Union, trading as MyProtektor ("we," "us," or "our").

By accessing, browsing, or using any part of the Website, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not accept any part of these Terms, you must immediately discontinue your use of the Website. Your continued use of the Website after any changes to these Terms constitutes your acceptance of the updated Terms.

These Terms apply to all visitors, registered users, and any other individuals who access the Website, regardless of whether they hold a paid subscription. These Terms are supplementary to and should be read in conjunction with our Terms of Service, Privacy Policy, Acceptable Use Policy, and Cookie Policy, all of which are available on the Website.

These Terms apply to the following:

• Public Website: All publicly accessible pages including the homepage, pricing information, blog articles, documentation, legal pages, and marketing content.
• Authenticated Dashboard: The web-based application dashboard accessible after logging into a MyProtektor account, including all operational features such as incident management, guard tracking, patrol verification, and analytics.
• Mobile Applications: The MyProtektor mobile applications distributed through the Google Play Store and Apple App Store, including all features accessible through the mobile interface.
• API Endpoints: Any application programming interfaces provided by MyProtektor for integration purposes, accessed either through the platform's own applications or through authorised third-party integrations.

3. Intellectual Property

All content, materials, and intellectual property available on or through the Website are the exclusive property of MyProtektor or its licensors and are protected by South African and international copyright, trademark, patent, and other intellectual property laws.

This includes, without limitation:

• Software and Code: The platform's source code, compiled code, algorithms, data structures, user interface designs, and application logic.
• Visual Identity: The MyProtektor name, logo, colour schemes, typography, icons, and all other branding elements.
• Content: All text, images, photographs, graphics, illustrations, videos, audio files, and multimedia content published on the Website.
• Documentation: User guides, help articles, API documentation, blog posts, and other written materials.
• Data Structures: Database schemas, data models, and the organisational structure of information within the platform.

No part of the Website may be reproduced, distributed, modified, adapted, publicly displayed, transmitted, or otherwise exploited for any commercial purpose without our prior written consent. You may not use our trademarks, service marks, or trade dress in connection with any product or service that is not ours, in any manner likely to cause confusion, or in any manner that disparages or discredits MyProtektor.

4. Permitted Use

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, and revocable licence to access and use the Website for its intended purpose: to explore, evaluate, and utilise the MyProtektor security management platform in accordance with your subscription plan and assigned user role.

Permitted uses include:

• Browsing the public Website to learn about MyProtektor's features and services.
• Creating and managing a MyProtektor account in accordance with our Terms of Service.
• Using the authenticated dashboard and mobile applications to perform security management operations within your organisation's account.
• Accessing documentation and help resources to support your use of the platform.
• Printing or downloading individual pages for your own personal, non-commercial reference, provided that all copyright and proprietary notices are retained.

5. Prohibited Conduct

When using the Website, you agree that you will not engage in any of the following prohibited activities:

• Unauthorised Access: Attempt to gain access to any part of the Website, server, database, or network that you are not authorised to access, including by using another person's credentials, exploiting security vulnerabilities, or bypassing authentication mechanisms.
• Reverse Engineering: Decompile, disassemble, reverse-engineer, or attempt to derive the source code of any software or technology used in the Website, except to the extent expressly permitted by applicable law.
• Automated Collection: Use any robot, spider, scraper, data mining tool, or other automated device, process, or means to access, crawl, scrape, or index the Website or its content without our prior written consent.
• Interference: Interfere with, disrupt, or place an unreasonable load on the Website's infrastructure, including through denial-of-service attacks, flooding, mail bombing, or any other method designed to overwhelm or impair service availability.

• Impersonation: Impersonate any person or entity, falsely claim an affiliation with any person or entity, or misrepresent yourself or the source of any content you submit.
• Unlawful Purposes: Use the Website for any purpose that is illegal, fraudulent, or harmful, or in connection with any illegal, fraudulent, or harmful activity under the laws of South Africa or any other applicable jurisdiction.
• Circumvention: Attempt to circumvent, disable, or interfere with any security feature, access control, usage limitation, or content protection mechanism on the Website.
• Competitive Intelligence: Access or use the Website for the purpose of building or supporting a competing product or service, or for any benchmarking or competitive analysis without our prior written consent.
• Content Misuse: Frame, mirror, or create derivative works from any content on the Website, or present Website content in a manner that suggests endorsement by or association with MyProtektor without authorisation.

6. User Submissions

The Website may permit you to submit, upload, or transmit content including but not limited to incident reports, photographs, comments, location data, and other materials ("User Submissions"). You retain ownership of any intellectual property rights you hold in your User Submissions.

By submitting content through the Website, you grant MyProtektor a worldwide, non-exclusive, royalty-free, transferable licence to use, store, reproduce, modify, and display your User Submissions solely for the purpose of operating, improving, and providing the Service to you and your organisation. This licence continues for as long as your content remains on our platform and for a reasonable period thereafter to allow for backup retention and deletion processing.

You represent and warrant that you have all necessary rights and permissions to submit any User Submissions, that your submissions do not infringe the intellectual property or privacy rights of any third party, and that your submissions comply with all applicable laws and our Acceptable Use Policy.

7. Warranty Disclaimers

The Website and all content, features, and services available through it are provided on an "as is" and "as available" basis without any warranties of any kind, whether express, implied, or statutory.

To the fullest extent permitted by applicable law, we disclaim all warranties including but not limited to:

• Implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
• Warranties that the Website will be uninterrupted, error-free, secure, or free of viruses or other harmful components.

To the maximum extent permitted by applicable law, MyProtektor, its founder, employees, agents, partners, and service providers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, business opportunities, goodwill, or anticipated savings, whether arising from contract, tort (including negligence), strict liability, or any other legal theory, even if we have been advised of the possibility of such damages.

In no event shall our total aggregate liability to you for all claims arising out of or relating to your use of the Website exceed the lesser of: (a) the total fees paid by you to MyProtektor in the twelve (12) months immediately preceding the event giving rise to the claim; or (b) fifty thousand South African Rand (R50,000).

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable South African law.

9. Third-Party Links

The Website may contain hyperlinks to websites, services, or resources operated by third parties that are not owned or controlled by MyProtektor. These links are provided for your convenience and informational purposes only. We do not endorse, approve, or assume any responsibility for the content, privacy policies, practices, or availability of any third-party websites or services.

You acknowledge and agree that MyProtektor is not responsible or liable, directly or indirectly, for any damage, loss, or harm caused or alleged to be caused by or in connection with your use of or reliance on any content, goods, or services available through any third-party website or resource. We encourage you to review the terms of use and privacy policy of any third-party website before providing personal information or conducting transactions.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa, including but not limited to the Electronic Communications and Transactions Act, 2002 (Act 25 of 2002) ("ECT Act"), the Consumer Protection Act, 2008 (Act 68 of 2008), and the Protection of Personal Information Act, 2013 (Act 4 of 2013).

Before initiating formal legal proceedings, you agree to first attempt to resolve any dispute informally by contacting us in writing. If informal resolution is unsuccessful within thirty (30) days, either party may refer the dispute to mediation administered by a mutually agreed mediator in South Africa, with costs shared equally. If mediation does not resolve the dispute within sixty (60) days, either party may pursue the matter through the courts of the Republic of South Africa. You consent to the jurisdiction of such courts and waive any objection to the exercise of jurisdiction by such courts on the grounds of venue or inconvenient forum.

In compliance with the ECT Act, we confirm the following: MyProtektor is operated by Mike Roth, Michael-Gaismayr-Strasse 52b, 6900 Bregenz, Austria, European Union; the principal place of business for purposes of electronic communications is accessible via the contact details provided in Section 14 of these Terms; users may lodge complaints with us using those same contact details.

11. Modifications to These Terms

We reserve the right to modify, amend, or replace these Terms at any time at our sole discretion. When we make material changes, we will update the version number and effective date at the top of this page. For registered users, we will provide notice of material changes by email or through a prominent notification on the Website at least fifteen (15) days before the changes take effect.

It is your responsibility to review these Terms periodically for changes. Your continued use of the Website after the effective date of any modifications constitutes your acceptance of the revised Terms. If you do not agree with the modified Terms, your sole remedy is to discontinue your use of the Website.

12. Severability

If any provision of these Terms is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, that provision shall be modified to the minimum extent necessary to make it valid, legal, and enforceable, or if modification is not possible, it shall be severed from these Terms. These Terms supersede all prior or contemporaneous communications, proposals, and agreements, whether oral or written, between you and MyProtektor relating to the subject matter of these Terms.

No waiver of any provision of these Terms shall be deemed a further or continuing waiver of such provision or any other provision. Our failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
